Legal Status of Suspended Police Officer Abba Kyari
The Nigeria Correctional Service (NCoS) FCT Command has confirmed that the suspended Deputy Commissioner of Police, Abba Kyari, is still in its custody. This statement comes despite reports suggesting that Kyari had been discharged by a court in one of the cases against him.
Samson Duza, the Public Relations Officer (CPRO) of the NCoS FCT Command, addressed these claims during an interview with the News Agency of Nigeria (NAN) on Thursday in Abuja. He clarified that while Kyari was indeed discharged in one of the cases, he remains in the custody of the correctional service due to another ongoing legal matter.
Duza explained that Kyari is currently facing two separate charges. The first involves allegations of wrongful declaration of assets, and the second relates to a drug-related offence. According to the CPRO, the recent court decision only pertained to the asset declaration case.
He stated that the court discharged Kyari in the asset declaration case because the prosecution failed to provide sufficient evidence to support the allegations. “The judge described the case as weak, and the prosecution was unable to substantiate the claims made against him,” Duza said.
However, the CPRO emphasized that Kyari’s legal troubles are not over. The drug-related case is still pending before the court, and as such, the suspended police officer continues to be held in custody. “The ongoing trial for the drug-related offence has not been concluded, and Kyari will remain in the custody of the NCoS until the proceedings are finalized,” he added.
Background on Abba Kyari
Kyari, who previously served as the head of the Intelligence Response Team (IRT) of the Nigeria Police Force, has been involved in legal battles following allegations linking him to drug trafficking activities. These allegations have led to his suspension from duty and subsequent legal proceedings.
The clarification from the correctional authorities came after widespread reports suggested that Kyari had been fully discharged by the court. However, the NCoS reiterated that Kyari remains in lawful custody until the outcome of the drug-related case is determined.
Ongoing Legal Proceedings
The situation highlights the complexity of Kyari’s legal status and the importance of distinguishing between different charges brought against him. While one case has been dismissed due to insufficient evidence, the other remains active and could lead to further legal consequences if the prosecution succeeds in proving the allegations.
The NCoS FCT Command has maintained that it is fulfilling its duty by ensuring that Kyari remains in custody until all legal matters are resolved. This approach reflects the standard procedure in such cases, where individuals are detained until their trials are completed.
Conclusion
As the legal process unfolds, the public and media continue to monitor the developments surrounding Abba Kyari. The NCoS has made it clear that the suspended police officer is not free to leave custody until the drug-related case is concluded. This underscores the importance of due process and the need for thorough investigations in legal matters involving high-ranking officials.
