Election Ballots in Fulton County Face Legal Uncertainty Amidst FBI Involvement

A recent legal battle concerning ballots from the 2020 election in Georgia’s Fulton County has taken a significant turn, with a judge officially dismissing one lawsuit and placing another on hold. The developments stem from a complex interplay between local court proceedings, federal investigations, and the ongoing scrutiny of the 2020 election results.

Fulton County Superior Court Judge C.I. McBurney, who was appointed to the bench in 2012, issued rulings that have effectively removed his court’s jurisdiction over the disputed ballots. The primary lawsuit that has been dismissed was filed by conservative activist Garland Favorito, a prominent figure known for challenging the integrity of the 2020 election. Favorito’s suit sought access to the 2020 ballots in Fulton County for viewing.

Initially, Judge McBurney had indicated a willingness to allow public access to these ballots upon request. However, a subsequent event dramatically altered the legal landscape: an FBI raid on an election facility in Fulton County in late January. This federal action, reportedly supported by Favorito, meant that the ballots in question were seized and are now technically in the possession of the Department of Justice.

Following the FBI’s involvement, Judge McBurney concluded that the ballots were no longer under his court’s purview. He stated in his written decision that because the ballots now belong to the Justice Department, the issue was “effectively out of his hands.” Favorito himself acknowledged this shift, commenting that the court’s decision was “legally moot since the FBI has the ballots.” McBurney expressed a hope that the federal agencies would handle the ballots and associated records with the utmost care to preserve their integrity.

A Separate Case Also Impacted

Adding to the legal complexities, Judge McBurney also issued a stay, or pause, on a separate civil case. This second case was initiated by the Georgia State Board of Elections, an entity reportedly populated by Republican activists who support former President Donald Trump. Their lawsuit also sought access to the 2020 Fulton County ballots.

In his ruling on this separate matter, the judge noted that the ballots “were, until recently, here in Fulton County. Now, however, they are somewhere else. Where exactly the court cannot say.” He further observed that the warrant for the ballots was signed by the U.S. Attorney’s Office for the Eastern District of Missouri. This detail led him to speculate that the Fulton County ballots might actually be located in Missouri, often referred to as the “Show Me State.” The implication is that jurisdiction for this case may lie with federal authorities in Missouri, rather than the Fulton County court.

Previous Dismissal and Financial Penalties

These recent rulings are not the first time Judge McBurney has taken action regarding efforts to review the disputed Fulton County ballots. Just days prior to these latest decisions, he dismissed another lawsuit with a similar objective. In that instance, McBurney found that the plaintiffs, including Garland Favorito, had “presented zero legal or factual question” concerning Fulton County’s liability for their claims.

Furthermore, in that earlier dismissal, Judge McBurney imposed significant financial penalties on the plaintiffs, ordering them to pay approximately $40,000 in fines. This suggests a judicial weariness with what the court perceived as unsubstantiated legal challenges.

The ongoing saga of the 2020 election ballots in Fulton County highlights the intricate legal pathways and the persistent challenges to election integrity that continue to unfold across the United States. The involvement of federal agencies like the FBI and the shifting jurisdictional boundaries underscore the complex nature of these investigations and their impact on local court proceedings.
